The Fannings sought direct appeal to the 4th Circuit of the bankruptcy court's denial of their motion for authorization to incur debt to purchase a home, which also sought to abrogate local bankruptcy rules requiring such authorization.
A federal program has been reported to make it easier to get student loan debt discharged in bankruptcy. This is nothing new over the last two years but has been sluggish in making clear headway. Deputy Sheriff Godrey arrived at the scene and directed Atkinson to exit the vehicle so that it could be repossessed. Intimidated by an armed law enforcement officer, Atkinson complied and Carolina Repo took the car.
